Opposition settlement: what the decision maker looks at

Opposition settlement is a procedural moment, not a final answer. The case handler checks whether the settlement is complete, signed by someone with authority, and covers the full scope of the dispute. If any part is missing, the file stays open and the normal timetable resumes. Nothing about the underlying rights changes until the paperwork does.

What changes once settlement is filed

Filing a settlement request pauses the clock, but it does not close the file by itself. The Opposition Division treats a settlement notice as a request, not a decision. Until the office confirms withdrawal, restriction, or termination, the opposition remains formally pending. This matters for anyone tracking deadlines on related filings, because a pending opposition still blocks registration of the contested mark.

The practical risk sits in the gap between "agreed" and "recorded." Parties sometimes assume that a signed settlement ends the matter immediately. It does not. The office still has to act on it, and until it does, the applicant cannot rely on the mark as registered.

Steps to take

  1. Confirm authority to sign. The representative on file must have the mandate to settle, not just to file. The case handler checks signatures against the record.
  2. State the scope precisely. Full withdrawal, partial restriction, or coexistence must be spelled out. Vague wording sends the file back for clarification, which costs time.
  3. Request suspension if more time is needed. A joint request to suspend the proceedings keeps the file open without triggering the substantive deadline. The mechanism is close to what applies in a stay pending validity in a related patent dispute: a formal pause, not a withdrawal.
  4. Submit through the correct channel. The office accepts settlement documents only through its own filing system or the representative of record. Informal correspondence is not enough.
  5. Check the goods-and-services list against the settlement text. If the settlement restricts scope, the restricted list must match exactly what both sides agreed. Mismatches are a common reason for rejection.

Who decides and by when

The case handler in the Opposition Division decides whether the settlement is procedurally sound. If it is, the handler closes the file on the terms filed. If it is not, the handler issues a deficiency letter and sets a further deadline for correction. Neither side chooses the timetable; the office sets it and communicates it directly to both representatives.

Once the office issues a decision on the merits, settlement can no longer stop it. That is the point of no return. A settlement filed after the decision is dated is treated as a separate matter, not as a bar to the ruling already issued.

StageWhat the case handler checks
Filing of settlementSignature authority, completeness of scope, correct channel
Suspension requestJoint request, clear reason, agreed length of pause
Recording of outcomeMatch between settlement text and register entry
After a decision issuesWhether the decision is final or still open to settlement

Common forks

If the settlement includes a licence rather than a plain withdrawal, the parties usually need a separate agreement covering how the licence ends. A termination for convenience clause is common in that context, because it lets either side exit without alleging breach.

If the contested goods include digital or token-based products, the restriction wording needs to track how supply is defined for that category. What supply token issuance means in a file affects how narrowly the restriction can be drafted without leaving a gap the other side can exploit later.

If the other side has gone quiet mid-negotiation, the case handler will not chase a settlement that never arrives. The file proceeds on the existing timetable, and silence is treated as a decision not to settle.

What this page does not cover

This page does not cover how the underlying opposition itself is argued, or how evidence of use is assessed. It does not set out fees, filing costs, or how long the whole opposition runs from start to finish — those depend on the specific file and the office's own calendar. It also does not cover appeals against a final decision; that sits in a separate procedure with its own timetable.

Sources and limit

The description above reflects the settlement and suspension practice applied by the European Union Intellectual Property Office in opposition files, checked against current filing guidance as of the review date below. It does not amount to legal advice on a specific file, and it does not replace a check of the current status of a given opposition.

Where a settlement touches on rights that were assigned or licensed before the dispute started, the question of who holds authority to settle can become contested in its own right. Asset report when an assignment is missing: who decides sets out how that gap is normally resolved once it surfaces in a file.

FAQ

How long does opposition settlement take in practice?

There is no fixed length. It depends on the stage the file has reached, whether both sides request suspension, and how quickly the case handler processes the paperwork once it is complete. A well-drafted settlement filed with the correct signatures moves faster than one that needs correction.

Which documents are needed to start?

A signed settlement request from an authorised representative, a clear statement of scope — full withdrawal, restriction, or coexistence — and, if the goods-and-services list changes, the exact restricted wording. Incomplete scope is the most common reason a filing is sent back.

What happens if the other side does not respond?

The proceedings continue on the existing timetable. The office does not wait indefinitely for a settlement to materialise, and a decision on the merits can still issue while informal talks are ongoing.
