Invalidity and revocation: costs drivers

The cost of an invalidity or revocation case rarely tracks the size of the claim. It tracks the number of registers affected, whether the other side responds, and how much evidence must travel across borders before a decision-maker will look at it. A single mark with no counter-evidence resolves faster and more cheaply than a multi-register dispute against an active opponent.

What actually drives the cost

Every invalidity or revocation file starts from the same question: how much has to be proven, and to whom. A claim resting on non-use requires evidence of the market, not just a filing certificate. A claim resting on a prior right requires proof of that right in every register where it is invoked. The more registers, classes, and marks involved, the more evidence has to be assembled and reviewed before submission.

Response behaviour changes the shape of the file just as much as the substance of the claim. An unopposed application proceeds on the papers already filed. An opposed one triggers an exchange of submissions, sometimes a hearing, and additional rounds of evidence. The decision-maker's workload — and the client's — grows with each round.

Practical consequence

Once a deadline for response starts running, the practical margin for gathering evidence shrinks by the day. Instructing counsel early keeps the file within that margin. Instructing counsel after the deadline has already started narrows the choice of remedies available, because some procedural steps depend on timing that cannot be recovered once passed.

What to do

  1. Instruct the responsible attorney to map every register where the mark or design is recorded.
  2. Collect the original filing history and any prior correspondence with the relevant office.
  3. Confirm whether a response deadline is already running before any other step.
  4. Instruct local counsel to secure evidence of use, or evidence of non-use, before it is submitted.
  5. Send the assembled file for a scope assessment before the first written submission is drafted.

Who decides and by when

A national mark or design is reviewed by the national office responsible for that register. A mark covering the whole Union is reviewed by the relevant Union agency, with an internal appeal body sitting above the first decision-maker. Either route can end in a further appeal to a court, depending on where the case started. The forum is fixed by where the right was registered, not by where the parties are based.

Timing within each forum depends on the office's own workload and on how much evidence the parties submit. Cases with no response conclude within a standard administrative cycle. Contested cases with several rounds of submissions take considerably longer, and the length is set by the exchange itself, not by a fixed calendar.

How this fits your wider portfolio

If enforcement runs in parallel with the invalidity claim, the decision-maker applies reasoning close to how enforcement of an injunction is assessed elsewhere in the portfolio.

If the disputed mark sits inside a licensing arrangement, the underlying contract's audit right technology contract explained may become relevant to the evidence you can demand from a licensee.

If the same brand also covers a tokenised asset, that asset follows its own filing timeline, set out separately in what changed in filing formalities token issuance.

If your case looks like this

If you hold only one national registration and no one has responded yet, the file stays small and the timeline stays short.

If the claim rests on non-use, evidence of actual market activity matters more than the registration certificate itself.

If the opponent has already filed evidence of use, expect at least one further round of submissions before a decision issues.

What this page does not resolve

This page does not calculate a fee for a specific file, and it does not replace a jurisdiction-specific evidence checklist. It does not cover customs seizure of counterfeit goods bearing a disputed mark, which follows a separate enforcement track outside invalidity and revocation proceedings.

Verified

This overview reflects current filing and response practice as observed in office correspondence and case files. It is reviewed periodically as procedural practice evolves; the last review predates publication of this page. No article or regulation number is cited here, because this page describes procedure rather than legal basis.

FAQ

How long does an invalidity or revocation case take in practice?

Timing depends on the number of registers, whether the other side responds, and how much evidence needs translation. An unopposed case concludes within a standard cycle; a contested one takes as long as the exchange of submissions requires.

Which documents are needed to start?

A copy of the registration, any prior correspondence with the office, evidence supporting the claim, and a power of attorney for the instructed representative.

What happens if the other side does not respond?

The office proceeds on the evidence already filed and issues a decision without a further exchange of submissions.
