Stay pending validity: what the decision maker looks at

A stay pending validity puts the infringement or revocation timetable on hold until a parallel validity challenge is resolved elsewhere. The decision maker weighs how advanced that challenge is, its prospects, and the prejudice a pause causes each side. Stays are the exception, not the default, and most requests are refused.

What changes if a stay is granted

Once a stay is granted, the infringement clock stops. Deadlines for evidence, disclosure and hearing dates pause, and the case resumes only after the parallel proceeding produces a result. A refusal keeps the original timetable running, with the risk that the case reaches judgment before the validity question is settled elsewhere.

A grant favours a defendant who might otherwise be enjoined on a right that could later be narrowed or revoked. A refusal favours a claimant who would otherwise watch an ongoing infringement continue while a slower forum works through its own queue. Neither outcome is free, which is why the decision maker treats the request as a genuine balancing exercise rather than a formality.

The same weighing test appears whenever a forum sets the cost of waiting against the cost of moving early. Digital custody disputes raise an identical dilemma; see When custody is held by a platform explained.

What to do before you ask for — or resist — a stay

  1. Ask your litigation counsel to map every parallel proceeding touching the same patent, including oppositions and revocation actions.
  2. Instruct the team preparing evidence to keep working on the underlying facts, since a stay rarely freezes evidence-gathering entirely.
  3. File a reasoned request stating the current stage of the parallel challenge, not just the fact that one exists.
  4. Set your own internal deadline for a ruling on the stay, separate from the forum's timetable, so business planning does not depend on it alone.
  5. If you oppose a stay, prepare a short note on the prejudice delay causes you, such as continuing infringement or lost licensing revenue.
  6. Keep a single dated record of every filing and hearing date, since a renewed request will be measured against the earlier one.

Who decides, and on what timetable

The forum hearing the infringement or revocation case usually holds the discretion to stay its own proceeding. The forum handling the parallel validity challenge has no say over whether the other case pauses; it simply continues at its own pace.

Three situations that turn on this test

If your parallel validity challenge is close to a ruling, ask for a stay early. A pause that ends soon costs little to grant, and a decision maker is more willing to agree.

If the challenge to validity only appeared after litigation started, expect resistance. Forums are familiar with filings timed to buy time rather than to test the right.

If both sides underestimate how long the parallel proceeding will run, plan for the case to stay open longer than either party expected at the outset.

What this page does not resolve

This page covers the stay itself, not what happens once it lifts, and not whether the party behind the parallel challenge is worth pursuing at all. A dispute is sometimes a symptom of a wider counterparty problem, best uncovered before a contract is renewed rather than after; see Counterparty report before renewing a contract in practice.

Frequently asked questions

How long does a stay pending validity typically take?

There is no fixed period. The forum measures its own docket against the parallel validity proceeding, and a stay commonly runs from several months to beyond a year once an appeal is added.

Which documents are needed to start a request?

A short statement identifying the parallel proceeding, its current stage and evidence of either prejudice or genuine progress supports the request. Most forums decide on the papers or after a brief hearing.

What happens if the other side does not respond?

Silence does not grant the stay by default. The requesting party still carries the burden, and the decision maker weighs the same factors alone, as if the request were opposed.
