Opt-out and withdrawal of opt-out: costs drivers

Opt-out and withdrawal of opt-out are registration choices, not litigation. What they cost depends on how many patents sit in the bundle, how many proprietors must sign, and whether a national dispute is already running on the same patent. A single patent with one proprietor is quick and inexpensive to register. A large bundle with co-owners in several jurisdictions is not, and the difference shows up in the fee, not in the procedure itself.

What changes once you file

An opt-out removes a European patent from the jurisdiction of the new unified system for its remaining life, unless it is later withdrawn. Withdrawal puts it back, but only once. Neither step changes the scope of protection or the validity of the patent. Both steps change only which forum can hear a future dispute about it. That is why the timing question matters more than the paperwork question: the paperwork is short, the forum choice is not easily reversed.

What drives the cost

Four factors move the fee more than any other variable. Each one is checked with the client before an estimate is given, and the estimate itself follows within one working day.

FactorEffect on cost
Number of patents in the bundleEach patent needs its own entry on the registration record
Number of proprietors and co-ownersEvery proprietor must be identified and must sign the mandate
Existing national proceedingsA pending national case narrows the available window and speeds up drafting
Translation of the mandateA mandate signed abroad may need a certified translation before filing

None of these four is fixed in advance. A bundle of forty patents held by three co-owners across two countries costs more to register than a single patent held by one company, and the difference is almost entirely proprietor coordination, not drafting.

Stages and documents

Registration has five stages: identify the proprietors, confirm the patent bundle, prepare the mandate, submit the application, and receive confirmation. Nothing is filed before every proprietor named on the record has signed.

Withdrawal of an opt-out uses the same document set, plus confirmation that no national action on the same patent has started in the meantime. That last confirmation is the one clients most often overlook, and it is the one that stops a filing at the door.

Timing and the point of no return

An opt-out can normally be registered at any point before a national action starts on that patent, and it can later be withdrawn once. That withdrawal is the point of no return: once filed, the patent cannot be opted out again for the rest of its life. The rule works the other way too. A patent already the subject of an action in one forum cannot switch forum by opting out afterwards, regardless of how the paperwork is worded.

Confirmation of registration typically arrives within a few working days once the record is complete. Delay almost always comes from missing proprietor details, not from the registry itself.

Who decides

Registration is handled by the registry attached to the court, not by a judge and not at a hearing. There is no oral stage at this level and no discretion over the fee. A dispute about who actually counts as proprietor is a different matter, decided by the court itself, and it runs on its own timetable, separate from the registration record.

Forks

If the patent originates with a team that joined the company through an acquisition, ownership needs to be settled before an opt-out is filed, not after. A gap in the ownership chain surfaces at the worst possible moment, usually when a dispute has already started. See When an acquired team brings prior work in detail for what that check involves.

If the same technology is also licensed through a tokenised arrangement, that licence runs its own termination clock, and it does not pause because a patent opt-out is pending elsewhere. See Termination of a tokenised licence step by step explained for how the two timelines interact.

If the other side has already filed a central action, an opt-out filed afterwards has no effect on it. The case proceeds where it started, and the opt-out is simply refused.

Sources and the limit of this page

This page describes the mechanism, not the fee schedule of any registry. Fees are set and published by the registry itself, and they change without notice to this site. We confirm the current fee at the moment of filing, every time, rather than relying on what was true last quarter.

This page does not establish who actually owns a patent, whether a counterparty is solvent, or what a foreign entity has disclosed about itself. That kind of provenance work sits in a separate service; see Counterparty in Germany in practice for what can and cannot be established there.

Where a filing under this procedure names an individual and that naming is later disputed, the individual's own rights are handled separately; see If you are named in a report and its.

How the file is structured

Every opt-out file is built the same way, regardless of the client. A proprietor list, a mandate set, a bundle list, and a filing log sit in one folder. The log records every submission and every confirmation received, so a later withdrawal does not require rebuilding the record from scratch. No file is shared between clients, and nothing here is described in a way that could identify one.

Checked

This page is reviewed each time registry practice changes materially, not on a fixed calendar. Sources: the register kept by the relevant patent court, and the national patent registers of Lithuania and Estonia, consulted directly rather than through third-party summaries.

Frequently asked questions

How long does opt-out and withdrawal of opt-out take in practice?

Registration itself is fast once the record is complete: a few working days is typical. The slow part is gathering signatures from every proprietor, especially where ownership has changed hands since grant.

Which documents are needed to start?

A signed mandate from each proprietor, a list of the patents covered, proof of current ownership, and a contact address for service. Withdrawal additionally needs confirmation that no national action has started on the same patent.

What happens if the other side does not respond?

Opt-out and its withdrawal do not require the other side's agreement. Silence from an opponent has no effect on the registration; the only signatures required are those of the proprietors themselves.
